Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Cockpit (the “Service”), operated by Gigantic LLC of Seattle, Washington (“Gigantic,” “we,” “us”), the studio behind itsgigantic.com. By creating an account or using the Service, you agree to these Terms. If you are accepting on behalf of a company, you represent that you have authority to bind it.
1. The Service
Cockpit is a management dashboard for Webflow websites: uptime monitoring, content scanning, publishing controls, localization tooling, asset management, and related features. The Service connects to your Webflow account through Webflow’s official OAuth and acts only with the permissions you grant. Cockpit is not affiliated with, endorsed by, or sponsored by Webflow, Inc.
2. Accounts & teams
You sign in with a Google account; you are responsible for keeping that account secure and for all activity under your Cockpit account. Team owners control who joins their team and what the team connects. You must be at least 16 years old and provide accurate information.
3. Subscriptions & billing
- Paid plans bill monthly in advance through Stripe, our payment processor. We do not store your card details.
- Plan limits (sites, team members) are described on the pricing page.
- You can cancel anytime; your plan remains active until the end of the current billing period. Except where required by law, fees are non-refundable.
- We may change pricing with at least 30 days’ notice; changes apply from your next billing cycle.
- If payment fails, we may suspend access after a reasonable grace period.
4. Your content & connections
You retain all rights to your websites, content, and data. You grant us the limited rights needed to operate the Service — for example, fetching your public pages to scan them, calling the Webflow API on your behalf, and storing site metadata. OAuth tokens are stored encrypted. You are responsible for having the rights to connect the sites you connect (e.g., your clients’ sites).
5. Acceptable use
You agree not to:
- use the Service to violate any law or third-party right, or to monitor sites you have no authority over;
- probe, disrupt, or overload the Service, or attempt to access other customers’ data;
- resell or white-label the Service without our written agreement;
- use the Service to send spam or distribute malware.
6. Third-party services
The Service depends on third parties — including Webflow (site APIs), Google (sign-in, Sheets), Stripe (payments), and our hosting providers. Their availability and terms are outside our control, and your use of those services is governed by their own agreements.
7. Publishing actions
Cockpit lets you trigger publishes to your live websites. Publishes execute the current state of your Webflow project and generally cannot be undone by us. You are responsible for what you publish and when.
8. Availability & changes
We aim for high availability but the Service is provided without an uptime guarantee. We may add, change, or remove features. If we discontinue the Service, we will give you reasonable notice to export your data.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MONITORING AND SCANNING ARE BEST-EFFORT TOOLS AND MAY MISS ISSUES OR REPORT FALSE POSITIVES.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIGANTIC LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.
11. Indemnity
You will defend and indemnify Gigantic LLC against claims arising from your content, your connected sites, or your breach of these Terms.
12. Termination
You may stop using the Service and cancel at any time. We may suspend or terminate accounts that violate these Terms or create risk for the Service or other customers. Sections that by their nature should survive (4, 9–11) survive termination.
13. Changes to these Terms
We may update these Terms from time to time. For material changes we will notify you (e.g., by email or in-app) before they take effect. Continued use after the effective date constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in King County, Washington, and you consent to their jurisdiction.
